It was founded in 1897. Coordinates: lat 43 o 07' N and long 131 o 53' E The time zone: GMT + 10 hours. Harbor approach depth is 20-30m. Vessel traffic is monitored by the Vladivostok Vessel Traffic Management Center. The call sign is "Vladivostok-Port Control " at channel 67 VHF. Advantageous geographical location in the region's transport network predetermines the significant role of the Port of Vladivostok in overseas and short-sea shipping traffic in Asia-Pacific Rim. Trade partners of the port are more than 20 countries. JSC "Commercial Port of Vladivostok" is a regular member of International Association of Ports and Harbors (IAPH) , Association of Sea Commercial Ports (ASOP) Chamber of Commerce and Industry of Primorskiy Krai Commercial Port of Vladivostok Association International Coordinating Council on Transsiberian Transportation. The Vladivostok port maintains and develops sister-port relations with Tacoma (the USA), Niigata and Fushiki-Toyama (Japan), Dalian (China), Kaohsiung (Taiwan). The Port of Vladivostok handles a variety of cargoes - bulk, liquid cargo, forest products, general cargo, including containers. The Port has 16 berths available with a total length of 4,200m alongside; two of them are capable of taking cargo-passenger ships. All berths except for the berth No 16 are multipurpose ones. The berth No 16 specializes in handling containers. Shed area is 63,390m 2 , open storage area is 175,534m 2 . There are operational two refrigerated warehouses with 5,000m 3 capacity each. Oil Terminal provides enough capacity for the storage of 25,500 tons oil products. Alongside the berth a water depth allows the berthing of up to 20,000dwt tankers with draft of up to 10 m. Here there is bunkering of ships, as well as handling of export oil products. Cargoes mostly arrive in and leave the port by railway. Total length of on-dock rail tracks is 20 km. On-dock railway station capacity is 1,000 rail wagons. The port's service structure complies with relevant International standards, which includes stevedoring, agency, forwarding, towage, surveyor, tallyman and other companies . The vessels arriving in the Port of Vladivostok are provided with a complete set of modern services . The port's working regime, services rendered, the rules and rates of providing services are determined by the Port's Code of Customs . Brief Review N 43 o 07', E 131 o 53' The Commercial Port of Vladivostok the Commercial Port of Vladivostok is located on the north-western coast of the ice-free Golden Horn Bay. It was established in 1897. Advantageous geographic position, developed transport infrastructure, favorable natural conditions predetermine the most important role of the Vladivostok port in International and coastwise ocean-going traffic in Asia-Pacific Rim. Trading partners of the port are companies from more than 20 countries. JSC "Commercial Port of Vladivostok" and "Marine Administration of Port Vladivostok" (MAPV) are acting members of International Association of Ports and Harbors, ASOP, Chamber of Commerce and Industry, Commercial Port of Vladivostok Corporation, International Coordinating Council of Transsiberian Transportation. The port has a total quay length of 4,200m with depth ranging from 11,7 m to 13 m. Most of the berths are multi-purpose ones and designed for advanced and efficient handling of different types of cargo; two of them are passenger berths. The berthing length of dedicated container terminal No16 is 370m, the depth is 13m, its annual container handling capacity is 100,000 TEU. The container terminal is equipped with container cranes of 30.5 ton lifting capacity. The area of sheds is 54,100m 2 , open storage area is 71,700m 2 . There are operational two refrigerated warehousing facilities with capacity of 5,000m 3 each designed for 2,800 ton frozen products The Vladivostok port handles heavy-lift cargo with weight of up to 100tons. For handling heavy-lift and oversized cargo there is available self-propelled floating crane with lifting capacity of 100tons, as well as 100-tons capacity Gottwald harbour mobile crane and 63-tons capacity Gottwald harbour rail-mounted crane. There are operational two refrigerated warehousing facilities with capacity of 5,000m 3 each designed for 2,800 ton frozen products. The Commercial Port of Vladivostok carries out handling of oil products in bulk. Oil terminal, located on the Berth No11, is capable of accommodating up to 10,000 dwt vessels. There can be stored at a time up to 15,000 t light petroleum products, 5,000 t dark petroleum products, including oil. Most cargo are delivered and released from the port by railroad. Total length of the port rail tracks is 28 km. The capacity of port's railway station is 1,000 wagons. Thanks to the state-of-the-art service infrastructure including stevedoring, agency, forwarding, towage, surveyor's, tallying and other companies, cargo and ships are efficiently and fast handled in the port. Inbound vessels are rendered a comprehensive range of modern services, including Vessel Traffic Management Service, mooring, pilotage, supplying vessels with fresh water, fuel, shipchandler and other services. The port coordinates everyday work and interface of the carriers, agents, stevedoring and forwarding companies, customs, military cross-border authorities and other governmental bodies. At the port's territory cargo operations, the handling of ships used for the purposes of Merchant Shipping and other services usually rendered in the Commercial Port of Vladivostok are carried out by JSC "Commercial Port of Vladivostok" as well as the other operators - partnership and companies - according to their Articles of Association, licences obtained, contracts effected with JSC "Commercial Port of Vladivostok" and the "Code of Customs". 2. GENERAL back to the top 2.1. The Code of Customs of the Commercial Port of Vladivostok (hereinafter referred to as "Code of Customs") is founded on the Civil Code of the Russian Federation, Merchant Shipping Code, Federal Law of the Russian Federation of December 26, 1995 "About Joint-Stock Companies", mandatory directives of Marine Administration of Port Vladivostok in force within the port, practice of activity of commercial sea ports. 2.2. The Code of Customs determines the regime of work, services rendered, rules and rates of providing services given the duration and stability of their use. 2.3. The Commercial Port of Vladivostok accommodates the vessels with LOA up to 260m and draft of more than 11,7m. The vessels with the draft exceeding 11,7 m and the length more than 260 m are permitted to enter the port by Harbor Master in daylight and fine weather. 2.4. The pilotage of vessels and their servicing on the aquatorium of the port is obligatory: for ship of foreign flag - on the whole port's aquatorium; for Russian ships with conventional volume of 5,000 m 3 and more, the masters of which are not discharged from compulsory pilotage - on the aquatorium of inner roads; for tankers not being degassed and ships carrying hazardous cargo with conventional volume of 5,000m 3 and more - on the whole port's aquatorium. The pilotage on inner roads of the port is an intraport pilotage, on outer roads - outerport pilotage. 2.5. Berths, warehousing facilities, inner motor roads and other elements of within port's infrastructure are rented, owned or used by another real right from JSC "Commercial Port of Vladivostok" and other partnerships and companies having contractual and partnership relations with JSC "CommerciaL Port of Vladivostok". 2.6. JSC "Commercial Port of Vladivostok" and other licensed operators carry out cargo operations 2.7. Rates of ship handling in the port of Vladivostok are stated by JSC "Commercial Port of Vladivostok" annually in the first decade of January. Annually prior to the beginning of each freight year the Company states the tariff rates on cargo handling works (services) performed, mooring and other supporting operations, as well as a list of operators participating in technological process of cargo handling in the Port, and having contractual relations with the Company. 2.8. A list and rates of dues collected by the Commercial Port of Vladivostok are stated by Marine Administration of Port Vladivostok. 3. WORKING back to the top 3.1. The port is open to Russian and foreign vessels all year round. 3.2. Cargo works and auxiliary operations are carried out by the port round-the-clock, Saturdays, Sundays and Holidays excepted, break in work from 20:00 on December 31 to 24:00 on January 1 excepted. The working hours of the port is from 08:00 to 17:00, Saturdays, Sundays and Holidays excepted. 3.3. National holidays are as follows: January 1,2 - New Year; January 7 - Christmas; February 23 - Motherland Defenders' Day March 8 - International Women's Day; May 1, 2 - Spring and Labour Day; May 9 - Victory Day; June 12 - Day of the Adoption of Declaration of National Sovereignty of the Russian Federation; November 7 - Day of Consent and Reconciliation; December 12- Constitution Day of the Russian Federation; 3.4. Registration of vessels and cargo are made round-the-clock. 4. SERVICES RENDERED back to the top 4.1. The Commercial Port of Vladivostok renders the following services: 4.1.1. Services on cargo transfer, warehousing and storage: cargo handling operations; cargo transshipment to sea transport from any kind of transport vice versa, directly and via warehouse; dry cleaning of ship's cargo compartments; cargo securing on means of transport; cargo storage; cargo weighing; repacking, remarking and sorting out of cargo; carrying out by arrangement with railway authorities the dimensioned sketches and drawings for oversized cargo and heavy lifts; carrying out by arrangement with railway authorities the dimensioned sketches and drawings for oversized cargo and heavy lifts; cargo separation. 4.1.2. Servicing of vessels and other means of transport: cargo transportation; passenger transportation; rendering services to passengers at the territory and aquatorium of the sea port and roads; manoeuvring operations on the aquatorium under jurisdiction Marine Administration of Port Vladivostok; ; sea towing of vessels and other floating objects; rendering boats for servicing ships on the roads; rendering tugs for mooring operations; rendering pilotage services; acceptance of intermodal transport to be handled; road traffic; ship agency service; shipchandler service; surveyor's service; forwarding service; customs clearance; removal of faecal, ballast, oiled water, as well as garbage and food wastes from ships; water supply; liquid fuel bunkering. 4.1.3. Organizational and general services: supplying berthed ships with electric power; connection of berthed vessels to telephone net and mobile radio communication (ships on the roads and port approaches); providing with permit regime and proper storage and security of cargo; repair of vessels and ship's equipment. 4.2. Services are rendered according to the following order: 4.2.1. All the services on cargo handling, warehousing, storage, organizational and general services are rendered by the Company on the basis of the agreements with cargo owners, their forwarders, agents or other representative authorized by cargo owner or written applications addressed to the Company, containing specific proposals by which it may be judged quite definitely about the intention of the Customer, made this application to consider himself to have concluded the agreement with the Company. 4.2.2. For executing separate operations on cargo handling, warehousing and storage the Company may appoint other licensed operators taking part in one-time technological process of cargo handling. 4.2.3. While effecting the agreement with the Customers the Company undertakescommitment and obligation for proper performance of the complete set of services, stipulated by subclause 4.1.1 and terms and conditions of the agreements concluded, including the operations performed by other licensed operators participating in the technological process of cargo handling. 4.2.4. The Company arranges and effects control over the proper observance of time rates and rules of performing services stipulated by the Code of Customs, licensed operators taking part in the technological process of cargo handling, if the operators have concluded by written consent of the Company direct agreements on rendering services, stipulated by subclause 4.1.1 of the Code of Customs. The procedure of making an agreement on services of the Company is given in Supplement 2. 4.2.5. Payment for services performed is determined by terms and conditions of the agreements made with Customers, and in case of their non-availability the charges being fixed by the port's calculation given the character, specific nature and volume of works ad services to be rendered. 4.2.6. The conditions of the agreements made with the customers, that supplement, change or cancel the provisions the Code of Customs are of primary importance. If there are any discrepancy arisen between the provisions of the Code of Customs and conditions of the agreements concluded, the conditions of the agreements shall be in force. 4.2.7. The Company enforces a lien on the Customers'cargo if they are insolvent and (or) they fail to make payment for the services rendered by the port in due time. Lien is considered to be right of the Company to realize the Customers' cargo on expiry of one calendar month from the date of notifying the Customers of exercising the lien by the Company with redemption of debt for services rendered from the cost of the cargo sold.The expenses on selling the cargo are borne by the Customers. 4.2.8. In the events specified by subclause 4.2.7. the Company has also the right for detention of the Customers' cargo until the latter effects full payment of the services rendered by the port and executes other commitments and obligations, stipulated by the conditions of the agreements made, including the ones connected with offsetting the costs and other losses of the Company. The Company has the right to detain cargo under bailment, despite that after cargo passed into the ownership of the Company, the right for them is acquired by the third person 4.2.9. Harbor Master as a rule detains a vessel until port dues and other services rendered by the port are paid completely. 5. PROCEDURE OF DELIVERY-ACCEPTANCE OF CARGO back to the top 5.1. The Company provides for transshipment, warehousing and short-term storage of cargo in accordance with the agreements concluded with the Customers. 5.2. In the agreement "Cargo of the Customer" shall include all the cargo in which relation the Customer has the authority to dispose of it on the basis of the agreements on forwarding services concluded with cargo owners or any other legal ground. 5.3. The Customer issues to the authorized persons, who carry out actions related to the fulfilment of its obligations under the contract, a power of attorney duly executed to carry out the above actions, and takes responsibility for actions of authorized representatives to the Company according to the Law of the Russian Federation. 5.4. The Customer guarantees that all its actions in respect to disposal of the cargo carried out in accordance with the agreement concluded are based on the duly executed legal rights concerning the said cargo, and is responsible for completeness and authenticity of all the documents and information in them presented to the authorized representative of the Company while disposing by the cargo. The Company is not obliged to check authenticity of signatures on documents presented by the Customer to the Company and legal power of the persons having signed the documents. 5.5. 20 days before the commencement of the month planned the Customer presents to the Company the application for delivery of export cargo and application for scheme of shipment of import cargo in rail cars. Delivery of cargoes to the Company warehouses is carried out after the Company confirms documentarily the acceptance of cargo due to be delivered. 5.6. The Carrier is obliged to deliver the cargo to the Port (accept the cargo from the port). The cargo transfer shall be drawn up by an appropriate report (tallyman's receipt) signed by the carrier and the Port or the organizations authorized by them. 5.7. Before the delivery of cargo to the Company's warehouses the Customer should present to the Company the following documents: Permission issued in accordance with the law of the Russian Federation on environment protection to transship contaminating cargo on the roads and berths of the Company if the Company confirmed the handling of the above cargo beforehand. Cargo information including transport characteristics and safety conditions of sea transportation of cargo as well as the Safety Rules of cargo handling operations. The declaration is issued and signed by the cargo owner or with its care involving the specialized organizations, if required. 5.8. Cargo arriving at the Company's warehouses, by its physical and chemical properties, packaging and marking should correspond to the "Rules of cargo transportation by sea, railway and road", appropriate standard technical documents (GOST and the like) in force as well as the technology for cargo handling adopted in the Company. 5.9. The cargo arrived at the Company in the quantity exceeding the agreed volume by more than 10 % is accepted by Company under the additional agreement. 5.10. Acceptance and shipment of piece and packaged cargo is made by counting packages by the weight stated by the shipper in the transport documents. Shipment of piece and packaged cargo from the Port is exercised in the same order. Acceptance of piece and packaged cargo arrived at the Company's warehouses, if they are stated as "bulk" in the railroad waybill, is made without checking the number of packages. Acceptance of cargo arrived in sound packages is made by the number of packages without checking the number of items in packages. If necessary, the weighing of cargo arriving by vehicles and railway is made on truck scales at the Port territory or on railway scales in the Vladivostok railway station. 5.11. Release of cargo from the Company's warehouses is carried out according to the terms of the contracts concluded. 5.12. The Company issues to the Customer an acceptance certificate for the export cargo accepted by the warehouse. Acceptance certificates serve as a confirmation of the quantity of cargo accepted. 5.13. Charges for storage of cargo, over and above standard storage of cargo on the Company's warehouses are made as per tariffs stipulated by the terms of the contracts effected. If the cargo was delivered to the Company's warehouse without agreement or prior to the agreed time, and if the rates of one-time cargo storage at the warehouses are exceeded, the Company has the right to establish higher rates for storage of the above cargo 5.14. In case the Customer has not given any special instructions on the regime of storing cargo or cargo has no marking which prescribes special regime of cargo storage, the Company has the right to select between the various available methods of its storage, including open storage or in sheds. The covering of cargo at the open storage area may be made at the request of the Customer by its materials or at its expense. 5.15. Securing of cargo on ships is made by the shipowner or at its expense. 5.16. Customs clearance, exercising all customs formalities required (including the inspection of cargo arrived at the port or the one loaded on the vessel) is the duty of the Customer and the expenses connected with the customs clearance are charged to its account and on its responsibility. In case the State Bodies (Customs etc.) delay the drawing up of the documents, decision-making concerning the shipment of cargo and payment for storage during the period stated is made by the Customer as per the Company's rates and tariffs in force. The Company has the right to fix limit terms of storage of the said cargo at its warehouses or set special tariffs for its storage. 5.17. If cargo is delivered to the Company's warehouses in faulty package, with violation of technical requirements of placing cargo on transport vehicles, with no dunnage or separation materials on vehicles, which makes it impossible to handle cargo in accordance with the technology adopted by the Company, the Customer pays to the Company additional expenses on actual costs incurred by the Company while handling the above cargo. 5.18. Transshipment of perishable cargo as well as raw sugar, grain and other foodstuff in bulk is carried out by the direct variant. 5.19. Facilities of packaging the cargo arriving at the port should be of supporting kind with upper points of fastening and have the appropriate certificate, or configurations of packages and methods of their placing on transport vehicles should make it possible to sling on or sling off without lifting, moving cargo and other operations carried out manually. Deviation from this condition is permitted only as agreed with the authorized representative of the Company 5.20. The Customer supplies the Company's warehouse with spare tare in the quantity required for repackaging of cargo arrived in damaged tare. If spare tare required is not delivered, Customer gives orders to deliver and takes out the cargo from the Company's territory to the address of Consignees within 10 days. 5.21. Delivery and transshipment of dangerous cargo under IMDG Code (International Marine Dangerous Goods Code) as well as lengthy, oversized, heavy lifts, bulky and heavy lift cargo, as well as cargo requiring special regimes of transportation and storage, special technologies of cargo handling shall be agreed with the authorized representative of the Company before the delivery of cargo to the Company's warehouses and made only after the written agreement with the Company in compliance with the rules of IMDG in force (transportation of hazardous cargo by sea), rules of railway transportation of dangerous cargo and other normative documents. 5.22. Before the property right for cargo stored in the Company's warehouses is passed to another Cargo Owner, the Customer is obliged to pay all services rendered by the Port and all the Company's expenses in respect to the above cargo. 5.23. The Company is not liable to the Customer for Damage to cargo due to precipitation, wind or other unfavorable weather conditions unless the Company acted contrary the instructions of the Customer; Damage or danger of damage to cargo caused by the lack or non-compliance with marking of cargo, incorrect or incomplete information of cargo, hidden faults and defects in cargo, lack or inadequacy of package, unsafe or faulty packaging and rigging facilities if they do not belong to the Company; Spare parts and details for unpackaged vehicles, mechanisms or other equipment if their quantity is not declared in transportation documents; Damages inflicted to transport vehicles or losses caused to the Customer as a result of strikes, bad weather or other reasons beyond the Company's control; Difference in weight of cargo calculated by draft survey and accepted by the authorized representative of the Company without reweighing, and the weight declared by the shipper in transport documents; Cargo when it is transported outside the Company's territory and since the cargo has been loaded on any transport vehicles (railway car, vessel, truck); Exemption, confiscation, sale, destruction of cargo by the State Bodies in accordance with the in-force-law of the Russian Federation if the above actions were not at the Company's fault; Quality of cargo which is sensitive to low temperatures and if it has not been carried from the Company's warehouses from October, 15 to April, 15. 5.24. The Company is liable for the damage at fault or loss of cargo in the order and volume established by the agreements with the Customers. 5.25. Unless otherwise provided by the terms of the contracts concluded, the Company is not responsible for shortage, loss, damage or for cargo shipped to the wrong address or damage to a vessel irrespective of the fact when it happened except the cases when Customer has proved that shortage, loss, damage or if cargo shipped to the incorrect address are caused by negligence or illegal actions or omissions of the Company or its regular employees. 5.26. In the event if the Company is responsible for indemnifying for the damage to: CARGO - maximum amount subject to payment is equal to the cost of cargo to which the claim is related but not more than: US$200 per one cargo package; US$2,000 per general damage under one case of damage; VESSEL - maximum amount subject to payment is equal to: the cost of that part of vessel to which the claim is related at the moment of damage or loss; the cost of repair (determined jointly by the surveyors appointed by the Company and shipowner). However the maximum amount subject to payment in no case may not exceed the amount which is equivalent to US$150,000. EQUIPMENT - maximum amount subject to payment is equal to the cost of repair (determined jointly by the surveyors appointed by the Company and shipowner and the owner of the equipment) or the cost of equipment to which the claim is related, but not more than US$150 per a unit of equipment. 5.27. The Company bears responsibility to the shipowner for damage of the vessel occurred at the Company's fault which is confirmed by the statement worked out in the compulsory participation of the Company's representative during the shift in which the damage occurred. 6.
